This Privacy Policy explains how Lotus Spaw LLC (“Spaw Cloud,” “we,” “us,” or “our”) collects, uses, and shares personal information in connection with the Spaw Cloud platform available at spawcloud.com and our related apps and services (the “Service”).
This policy applies to:
- Visitors to our website;
- Customers (pet grooming businesses and their team members) who subscribe to the Service; and
- End Clients (pet parents) whose information our Customers submit to the Service.
Please see Section 9 (“Our Role”) for the important distinction between the information we control directly and the information we process on behalf of our Customers.
1. Information We Collect
1.1 Information You Provide Directly
When you sign up, use the Service, or contact us, we may collect:
- Account information: name, business name, email, phone, password, job title.
- Billing information: billing address and payment method details (payment card numbers are collected and stored by our payment processor, Stripe, not by us).
- Business information: information about your grooming business, services, schedule, staff, and locations.
- Customer content: information you upload to the Service, including End Client records (names, contact details, pet information, appointment history, notes, photos) and messaging content.
- Communications: support requests, survey responses, and other information you send us.
1.2 Information Collected Automatically
When you use the Service, we automatically collect:
- Device and usage data: IP address, browser type, device identifiers, operating system, pages visited, features used, referring URLs, and timestamps.
- Log data: technical logs created by our servers.
- Cookies and similar technologies: see Section 7.
1.3 Information from Third Parties
We may receive information from:
- Stripe, about payment transactions, connected account status, and payouts.
- Authentication providers (such as Google), if you sign in with them.
- Service providers that help us with analytics, fraud prevention, and communications.
1.4 End Client Information
When you (as a Customer) use the Service, you submit information about your End Clients, such as their names, contact details, pet information, appointment history, and payment history. We process this information on your behalf as described in Section 9.
2. How We Use Information
We use information to:
- Provide, maintain, and improve the Service;
- Create and manage accounts and authenticate users;
- Process payments and facilitate transactions between you and your End Clients via Stripe;
- Send transactional messages (account, billing, security, service notifications);
- Respond to support requests and communicate with you;
- Personalize features and recommendations;
- Detect, investigate, and prevent fraud, abuse, and security incidents;
- Comply with legal obligations and enforce our Terms of Service;
- Send marketing messages about Spaw Cloud, where permitted (you can opt out at any time);
- Produce de-identified and aggregated analytics that do not identify any individual.
We do not sell personal information, and we do not use AI Features to train the general-purpose models of our AI providers on Your Data (see Section 4).
3. Legal Bases (for users in jurisdictions that require them)
Where applicable, we rely on the following legal bases:
- Contract: to provide the Service you signed up for;
- Legitimate interests: to improve the Service, secure our systems, and prevent fraud;
- Consent: for marketing and certain cookies, where required;
- Legal obligation: to comply with law.
4. AI Features
Some features use third-party artificial intelligence providers to generate drafts, summaries, or suggestions. When you use these features:
- We send relevant inputs you provide to our AI providers to generate output.
- We contractually require our AI providers not to use Your Data to train their general foundation models.
- Providers may briefly retain inputs for abuse monitoring consistent with their terms.
Do not submit highly sensitive information (such as Social Security numbers, payment card numbers, or medical records) into AI Features.
5. How We Share Information
We share information only as described below. We do not sell personal information.
5.1 Service Providers
We share information with vendors who process it on our behalf, including:
- Stripe (payments and payout processing);
- Cloud hosting and infrastructure providers;
- SMS and email delivery providers (for messages you send through the Service);
- AI providers (for AI Features);
- Analytics and monitoring providers;
- Customer support tools.
These providers are bound by contract to use information only to provide services to us.
5.2 Payment Processing
Payments run through Stripe. Stripe collects information directly (including card details), processes it under its own privacy policy, and shares information back to us (such as transaction status). See https://stripe.com/privacy.
5.3 At Your Direction
We share information when you direct us to, such as when you integrate a third-party tool with the Service.
5.4 Legal and Safety
We may disclose information if required by law, subpoena, or legal process, or if we reasonably believe disclosure is necessary to protect rights, property, safety, or to investigate fraud or security incidents.
5.5 Business Transfers
If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred to the successor entity, subject to this policy.
5.6 Aggregated or De-Identified Information
We may share aggregated or de-identified data that cannot reasonably identify an individual.
6. Data Retention
We keep personal information only as long as needed for the purposes described in this policy, including to provide the Service, comply with law, resolve disputes, and enforce agreements. When you cancel your account, Your Data remains available for export for 30 days, after which we may delete or de-identify it consistent with our retention schedule. Certain records (such as billing and tax records) must be retained longer to meet legal obligations.
7. Cookies and Tracking
We use cookies and similar technologies to:
- Keep you signed in;
- Remember preferences;
- Measure how the Service is used;
- Detect abuse and security issues;
- Deliver and measure marketing, where permitted.
You can control cookies through your browser settings. Blocking cookies may break core Service features. Where required by law, we present a cookie banner that lets you manage non-essential cookies.
We do not respond to Do Not Track browser signals but honor Global Privacy Control (GPC) signals for opt-out-of-sale/share purposes where applicable.
8. Security
We use administrative, technical, and physical safeguards to protect personal information, including encryption in transit, restricted access, and regular security reviews. No system is perfectly secure, and we cannot guarantee absolute security. Notify us immediately at support@spawcloud.com if you suspect unauthorized access.
9. Our Role (Customer Data vs. End Client Data)
9.1 Customer Data
When we handle information about our Customers and their team members (people who sign up for and administer the Service), we act as a controller / business and this Privacy Policy describes our practices.
9.2 End Client Data
When Customers submit End Client information to the Service, we act as a processor / service provider on behalf of the Customer, and the Customer is the controller / business. The Customer — not Spaw Cloud — decides what End Client information to collect, how to use it, how long to keep it, and how to respond to privacy requests.
If you are an End Client (a pet parent) and want to exercise rights over your information, please contact the grooming business that serves you directly. If you are unable to reach them, you may contact us at support@spawcloud.com and we will assist where we can.
10. Your Privacy Rights
Depending on where you live, you may have rights over your personal information, including to:
- Access the information we hold about you;
- Correct inaccurate information;
- Delete your information;
- Port your information to another service;
- Restrict or object to certain processing;
- Opt out of marketing communications;
- Opt outof the “sale” or “sharing” of personal information (we do not sell or share personal information for cross-context behavioral advertising, but we honor these requests as a best practice);
- Appeal a decision about your rights request.
To exercise a right, email support@spawcloud.com. We will verify your identity and respond within the timeframes required by law. We will not discriminate against you for exercising your rights. You can also authorize an agent to make a request on your behalf.
California residents have rights under the California Consumer Privacy Act (CCPA), including the right to know what categories of personal information we collect and disclose, the right to delete, the right to correct, and the right to limit use of sensitive personal information.
Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and other U.S. states with comprehensive privacy laws have similar rights. We will handle your request consistent with applicable state law.
11. Children’s Privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe we have, contact support@spawcloud.com and we will delete it.
12. International Users
The Service is hosted in the United States and intended for use by U.S.-based pet grooming businesses. If you access the Service from outside the U.S., you understand that your information will be processed in the U.S., where data protection laws may differ from those in your country.
13. Marketing Communications
With your permission where required, we may send marketing emails about features, offers, and updates. You can unsubscribe at any time using the link in any marketing email or by emailing support@spawcloud.com. Transactional messages (such as billing and account notifications) are necessary to provide the Service and will continue.
14. Third-Party Sites and Services
The Service may link to or integrate with third-party websites and services. We are not responsible for their privacy practices. Review their policies before sharing information with them.
15. Changes to This Policy
We may update this Privacy Policy. If changes are material, we will notify you by email or in-app notice and update the “Last updated” date above. Continued use of the Service after the update indicates acceptance.
